1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of the website at appliedpoliceresources.com (the "Site"), the products sold through it, and the OnScene mobile application ("OnScene" or "the App"), each provided by Applied Police Resources ("Applied Police Resources," "we," "us," or "our").
By placing an order, downloading a file, or using the App, you agree to these Terms. If you are entering into these Terms on behalf of an agency, department, academy, or other organization, you represent that you are authorized to bind that organization, and "you" refers to both you and that organization.
2. About Applied Police Resources
Applied Police Resources produces professional reference, training, and instructional material for law enforcement and public safety, and provides consulting services to agencies. Our mailing address and contact details appear in Section 17.
3. Reference Material — Not Legal Advice
Everything we publish is reference and training material. It is not legal advice, and it does not create an attorney-client relationship.
We reproduce statutes, summarize case law, and describe investigative procedure. Statutes are amended, cases are overruled or distinguished, and procedure varies by jurisdiction and by agency. Our material does not replace, and must never be relied upon in place of:
- the current official code or statutory text of your jurisdiction;
- your agency's policies, general orders, and standard operating procedures;
- guidance from your prosecuting attorney, agency counsel, or legal advisor;
- the judgment of a qualified professional in the relevant discipline.
You are responsible for verifying any statute, case, procedure, or calculation against the controlling authority before relying on it in an investigation, a report, a charging decision, or testimony. Calculation tools and figures state their assumptions and limits; those limits are part of the material and must not be disregarded.
4. Products and Services
We offer the following, each subject to these Terms and to any additional terms presented at the point of purchase:
- The Investigator's Field Reference — available as a printed hardcover and as a digital PDF edition;
- Field Reference Series figures — available as licensed digital files under the license tiers described in Section 6 (professionally printed wall posters are planned and will be covered by these Terms when offered);
- OnScene — a subscription iOS application, distributed through the Apple App Store from its public release, as described in Section 8;
- Consulting and professional services — scoped and quoted per engagement as described in Section 9.
5. Orders, Pricing and Payment
All prices are stated in U.S. dollars and exclude any applicable taxes and shipping unless expressly stated. We may correct pricing or product description errors and may cancel an order affected by such an error, in which case we will notify you and refund any amount charged.
We reserve the right to refuse or cancel any order, and to limit quantities. Acceptance of your order occurs when we confirm it or deliver the product, not when payment is authorized.
Purchase orders from agencies and academies may be accepted at our discretion; contact us for terms, a quote, and a completed W-9.
6. Digital Products and Licensing
Digital products — including the PDF edition of the book and Field Reference Series digital files — are licensed, not sold. You receive the license tier you purchased, and no other. License tiers are separately priced products; purchasing an individual license does not confer agency or organizational rights.
Individual License (included at the listed individual price): Licensed to the named purchaser only. You may print purchased files for display in your own office, classroom, or workspace, and keep the files on your personal devices. The files may not be shared, posted to shared drives, distributed within an organization, resold, or included in other products.
Agency License (a separate, separately priced product): Licensed to one agency, academy, or training facility at a single location. Internal reproduction and display are permitted, and files may be stored on the organization's internal training systems. Redistribution outside the licensed organization is prohibited. For multi-site or statewide licensing, contact us for a quote.
Delivered files may be digitally stamped with the purchaser's name and order number. You may not remove, obscure, or alter any watermark, stamp, attribution, or copyright notice. Use of a file beyond the scope of its license — including distribution of an individually licensed file within an organization — is a breach of these Terms and an infringement of our rights, and may result in termination of the license without refund.
7. Printed Products and Delivery
Printed books and posters are produced to order by third-party print and fulfillment providers. Production and delivery timelines are estimates, not guarantees, and we are not responsible for carrier delays. Risk of loss passes on delivery to the carrier. Colors and trim may vary slightly between print runs and from on-screen representations. Refunds and replacements for printed products are governed by our Refund Policy.
8. The OnScene Application
OnScene is distributed through the Apple App Store and is subject to Apple's terms in addition to these Terms. Subscriptions, including any free trial, are sold and processed by Apple through your Apple ID, not by Applied Police Resources. We do not process the payment and do not hold the funds. Billing, renewal, cancellation, and refunds for App subscriptions are handled by Apple; see our Refund Policy.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for its intended professional purpose. You may not reverse engineer, decompile, extract or redistribute the statute corpus or other bundled data, or use the App or its data to build a competing product.
Reports and other content you create in the App are yours. We do not receive them; see our Privacy Policy. You are responsible for the accuracy, retention, security, and lawful handling of any record you create or export, and for compliance with your agency's records-management obligations.
Statute data, case summaries, and reference content in the App are subject to Section 3. Each jurisdiction carries a data-currency date; verify against the official code before relying on any provision.
9. Consulting and Professional Services
Consulting engagements — including police services optimization, policy writing and review, form creation, crime-statistics reporting, evidence room management, equipment procurement, and training — are scoped, quoted, and contracted individually. The written proposal or engagement agreement for a given engagement governs its scope, deliverables, fees, schedule, and payment terms, and controls over these Terms to the extent of any conflict.
Deliverables are advisory. We do not assume operational command, and we do not accept responsibility for an agency's decisions, personnel actions, or compliance obligations. Policy documents we draft or review must be adopted, and are subject to review by the agency's own legal counsel, before they take effect.
10. Intellectual Property
All content we produce — text, figures, diagrams, photographs, layouts, the OnScene software, and the compilation and arrangement of reference material — is owned by Applied Police Resources or its licensors and is protected by copyright and other applicable law. Statutory text itself is in the public domain; our selection, arrangement, annotation, indexing, and presentation of it are not.
Except as expressly permitted by the license accompanying your purchase, you may not copy, reproduce, distribute, publish, display, adapt, or create derivative works from our content, or use it for commercial resale or for training or evaluating machine learning models.
11. Acceptable Use
You agree not to use the Site, the App, or our products to: violate any law or regulation; infringe the rights of others; circumvent licensing, watermarking, or access controls; introduce malicious code; disrupt or place undue load on our systems; or scrape, harvest, or bulk-download our content by automated means.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the Site, the App, and all products and content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the Site or App will be uninterrupted or error-free, that reference content is complete, current, or accurate for your jurisdiction, or that results obtained from any calculator or checklist are correct for a given set of facts. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
13. Limitation of Liability
To the fullest extent permitted by law, Applied Police Resources will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of evidence, suppression of evidence, adverse case outcomes, disciplinary action, or reputational harm, arising out of or relating to your use of the Site, the App, or our products, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to these Terms, the Site, the App, or any product or service is limited to the amount you actually paid to Applied Police Resources for the specific product or service giving rise to the claim during the twelve months preceding the event.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Applied Police Resources and its owners, officers, and contractors from any claim, demand, loss, liability, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of our products or content, your violation of any law or of the rights of a third party, or your handling of records you create or export.
15. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms, the Site, the App, or our products will be brought exclusively in the state or federal courts located in the Commonwealth of Virginia, and you consent to the personal jurisdiction of those courts. Nothing in this section limits the sovereign immunity or statutory obligations of a governmental purchaser.
16. Changes to These Terms
We may revise these Terms from time to time. The revised version takes effect when posted, with an updated effective date above, and applies to orders placed and use occurring after that date. Material changes will be identified in the posted version. Your continued use after a revision constitutes acceptance of it.
